1. Scope

These General Terms and Conditions apply to all contracts concluded between the operator of "Akkuify" — DigiSphereX (hereinafter "DigiSphereX") — and its customers in the version valid at the time of the order. The products offered include batteries, rechargeable cells, chargers and accessories. Primary customers are consumers; these terms also apply to entrepreneurs insofar as existing provisions do not require otherwise.

Akkuify is a brand of DigiSphereX.

2. Conclusion of contract

The product presentation in the online shop does not constitute a binding offer. By clicking "Order with payment obligation" you submit a binding offer. The contract is concluded when we confirm the order by e-mail or dispatch the goods.

3. Prices and payment conditions

All prices include statutory value added tax (VAT) and are stated in EUR (€). Shipping costs are shown separately during the checkout. Payment can be made via the payment methods offered at checkout (such as prepayment, PayPal or credit card). The purchase price is due immediately upon conclusion of the contract.

4. Delivery and shipping

With payment in advance, delivery takes place after receipt of payment; in all other cases after the order. Unless otherwise stated for an article, the delivery time within Germany is usually 1–3 working days after receipt of the order. Delivery to other EU countries is available via the shipping options shown at checkout. We ship with a trackable parcel service.

5. Batteries and electrical devices (BattG / ElektroG)

Batteries and rechargeable cells must not be disposed of with household waste. You are legally obliged to return used batteries; you can hand them in free of charge to us or to your municipal collection point. The crossed-out wheeled bin means that batteries and rechargeable cells must be collected separately; the symbols Hg, Cd or Pb indicate a mercury, cadmium or lead content. Electrical devices must also be disposed of separately in accordance with the ElektroG and can be returned free of charge.

6. Warranty and liability

Statutory warranty rights apply. The limitation period for warranty claims on new goods is two years from delivery. Liability for simple negligence is limited, to the extent permitted by law, to damages arising from the breach of essential contractual obligations (cardinal duties). Liability for intent, gross negligence, and injury to life, body and health remains unaffected. Liability for guarantees assumed by us follows the respective guarantee statement.

7. Right of withdrawal

Consumers are entitled to the statutory right of withdrawal of fourteen days. For details, please see our withdrawal policy.

Consumer dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

8. Final provisions

German law applies. For consumers, mandatory provisions of the law of the country in which they are habitually resident remain unaffected. For entrepreneurs, the exclusive place of jurisdiction for all disputes is the registered office of DigiSphereX.
